1. Operator and acceptance

DocsMint is operated by Vladislav Galibov, based in Cabanas de Tavira, Portugal ("DocsMint", "we", or "us"). Contact: docs@webs.cool. These Terms apply to the hosted DocsMint service and form a contract between you and DocsMint when you create an account, buy a plan, or use the Service. They apply to consumers and business users. You must be at least 18 years old and legally able to enter into this contract. If you use DocsMint for an organisation, you confirm that you can bind it.

2. Service and accounts

DocsMint provides a hosted document workspace with editing, imports, search, versions, sharing, optional AI features, and, where included in a plan, API or MCP access. Features and limits may vary by plan. You must provide accurate account information, keep credentials secure, and promptly tell us at docs@webs.cool about suspected unauthorised access. You are responsible for activity performed through your account unless mandatory law provides otherwise.

You retain ownership of documents and other content you create or upload. You give us a limited, non-exclusive licence to host, copy, transmit, index, transform, and otherwise process that content only as needed to provide, secure, support, and improve the Service in accordance with the Privacy Notice. You control whether content is private or shared. If you create a public link or publish content, anyone with access may view or copy it. Remove public access when it is no longer intended. You must have the rights and permissions needed for all content you submit.

4. Optional AI features

AI is optional. When you invoke it, the relevant prompt, document text or snippets, images, audio, search query, and settings may be sent to the providers described under Subprocessors & DPA. Outputs can be incomplete, inaccurate, biased, or unsuitable. Review them before use and keep appropriate human oversight. AI output is not legal, medical, financial, tax, employment, or other professional advice. Do not rely on it as a substitute for a qualified professional or use it for a high-impact decision without appropriate review.

5. Acceptable use

Do not use the Service to break the law; violate privacy, confidentiality, intellectual-property, or other rights; distribute malware; bypass security or limits; interfere with other users; scrape or access the Service without permission; impersonate others; or generate, store, or distribute unlawful or abusive material. Do not submit highly sensitive data unless it is lawful, necessary, and you have assessed whether the selected feature and its providers are appropriate. You must not use DocsMint for illegal surveillance, exploitation, fraud, or prohibited decisions about individuals.

6. Plans, Stripe, cancellation, and consumer rights

Free and paid plans may have different capabilities and usage limits. Where billing is enabled, Stripe processes checkout and payment details. Prices, taxes, billing period, and renewal terms are shown before purchase. You may cancel a subscription through the available billing controls; cancellation normally takes effect at the end of the paid period unless the checkout terms or mandatory law require otherwise. Nothing in these Terms removes mandatory EU or national consumer rights, including any applicable pre-contract information, withdrawal right, conformity remedies, refund, or statutory guarantee. If you ask for immediate supply of digital services during a withdrawal period, the consequences will be explained at checkout where required.

7. Suspension, termination, and export

You may stop using the Service and request account deletion. We may restrict or suspend access when reasonably necessary to address a security risk, unlawful use, material breach, non-payment, or harm to the Service or others. Where appropriate, we will give notice and an opportunity to remedy the issue. On termination, we will provide a reasonable opportunity to export your documents where technically feasible and lawful, unless urgent security, legal, or abuse concerns prevent it. Some records may remain for the limited periods described in the Privacy Notice.

8. Hosted service and self-hosted software

These Terms govern the hosted DocsMint SaaS. hiai-docs is separately available as open-source software under its own licence. A self-hosted deployment is operated by the person or organisation that installs it; they choose hosting, providers, security, backups, and data practices. DocsMint does not control a third party's self-hosted instance and is not responsible for it merely because it uses hiai-docs.

9. Availability, warranties, and liability

We aim to provide a useful and secure Service, but do not promise uninterrupted availability, error-free operation, or that every output will meet your needs. To the maximum extent permitted by law, the Service is provided as available and implied warranties are excluded. For business users only, and to the maximum extent permitted by law, DocsMint is not liable for indirect, incidental, special, or consequential loss, loss of profit, revenue, business, goodwill, or anticipated savings. DocsMint's aggregate liability arising from or relating to the hosted Service is limited to the fees that the business user paid for the Service during the 12 months immediately before the event giving rise to the claim. A business user is responsible for its unlawful content or instructions. To the extent permitted by law, it will indemnify DocsMint against a third-party claim arising directly from that content or those instructions infringing law or the third party's rights, but only to the extent caused by the business user's breach of these Terms. This does not cover a claim caused by DocsMint's own acts or omissions. These business-only exclusions, cap, and indemnity do not apply to consumers. Nothing excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or death or personal injury where applicable, and nothing restricts mandatory consumer remedies or other non-excludable rights.

10. Law, disputes, and changes

Portuguese law governs these Terms. The courts of Portugal have jurisdiction, but consumers keep any mandatory right to rely on the law or courts of their country of residence. We may update these Terms for legal, security, technical, or service changes. We will give reasonable notice of material changes where required. Changes do not remove rights already accrued.
